SCHEME OF PERFORMANCE OF OBSEQUIAL CEREMONIES FOR THE FIRST YEAR

 

OBJECTIVES AND PURPOSE

 

Many Parsi Zoroastrian individuals find themselves in a situation where, due to nucleur families, unmarried status, emigration of family members or otherwise, find themselves in a situation that they have no relatives who, surviving them, would carry out the obsequial ceremonies, the ‘reeti rivaj’ or ‘baj-rojgar’ after their death.  This situation cuts across economic strata of the Parsi community in India.   This Association seeks to provide an institutionalised response to resolve the difficulties faced by such persons of the community by providing an opportunity to make an endowment during their lifetimes for the performance of ‘baj rojgar’ ceremonies after their demise, in the event of there being no next of kin who would perform these.

 

PROCEDURE

 

The Association would play the role of a trustee of the funds endowed by an individual Parsi Zoroastrian, for his own benefit or for the benefit of another Parsi Zoroastrian, by investing the endowed funds in permitted investments and utilizing the total proceeds for paying the Agiary/Panthaky where the ‘baj rojgar’ ceremonies of the deceased are carried out, upon the happening of that event.  Every applicant would normally have an Agiary and a Panthaky who knows them and would be the first to be informed of the demise of the Applicant.  In case the Applicant has no such affiliation, he can opt for any Agiary/Panthaky who are registered with the Association as being willing to act as Panthaky for the Applicant under this Scheme.

 

The Applicant should keep in a prominent location at his residence, and inform his family, neighbours, friends of the fact that he is covered under this Scheme, and keep them informed of the name, address and contact numbers of the Agiary and Panthaky who is to be informed in the eventuality of his demise and also that of the Association.  The immediate actions for commencing the obsequial ceremonies and thereafter carrying them out for the first year would be carried out by the Panthaky and would not be the responsibility of the Association.  The Panthaky shall intimate to the Association of the fact of demise and the carrying out of the obsequial ceremonies and the Association shall pay the Agiary/Panthaky the charges thereof out of the amount endowed by the Applicant.

 

OPTIONS

 

The Association may at different points in time, depending on the needs of the community, costs, future obligations, etc. offer different options from which an Applicant may select one.  Initially, there shall be two options, each option relating to the coverage of the obsequial ceremonies that would be carried out during the first year after the demise of the Applicant.  The Association may at any time revise the amounts to be endowed for coverage under the Scheme.

 

COMPLETION OF OBJECT OF ENDOWMENT

 

Upon the completion of the first year of obsequial ceremonies as per the Option selected, in the event that costs have increased over and above the amount of endowment and the accumulated income thereon, the Association would arrange to bear the difference from its funds.  If there is any surplus available, the same shall at that time form part of the income of the Association to be used for the benefit of poorer members of the community or to recover the shortfall incurred for any other Applicant.

 

ADMINISTRATION

 

The Applicant shall fill up the Application Form of the Association to become first a member of the Association and thereafter to be covered by the Scheme. A Parsi Zoroastrian may fill the membership form the benefit of another Parsi Zoroastrian to be covered under this Scheme, either as an act of charity for poorer Parsis, or for the benefit of another for whom he is concerned.  The Scheme, the Option selected and the names to be recited in the prayers, shall be attached to the Application form and a copy thereof provided to the Applicant for his record. The Applicant thereafter would execute an Endowment Deed bestowing an endowment on the Association of the amount of money to be held in trust and invested in approved trust securities. The annual incomes from such accumulated amounts in the endowment shall be utilized only for the benefit of the Applicant upon the demise of the Applicant for the purpose of defraying the costs incurred for the first year obsequial prayers by the Agiary/Panthaky carrying out the same for the deceased.  The Association shall be entitled to rely on the statement and signed affirmation of the concerned Panthaky that the prayers have so been carried out before releasing the payment.

 

ANNUAL CONFIRMATIONS

 

The Association shall annually inform the Applicant of the particulars of the registration under this Scheme with a copy to the Panthaky, and should in turn receive from the Applicant of any changes in address, communication details, panthak etc. so that all parties have updated and relevant contact details.  In the event of change in Panthaky, contact person etc. the same should be informed immediately, but the annual confirmations would institutionalise the exchange and confirmation of information.

DEED  OF  ENDOWMENT

E. Mithaiwala Agiary Compound, Jehangir Daji Cross Lane, Sleater Road, Mumbai 400007 (hereinafter referred to as the ‘said Association’.

 

In order to secure the performance of obsequial ceremonies in accordance with the Parsi Zoroastrian tradition followed in Mumbai and more specifically set out in the Annexure hereto, for the first year after my demise/or demise of_________, I hereby bestow upon the said Association an endowment of Rs. ______________ (Rupees __________________________________ only), by cheque drawn on _________________________________________________ , to be held by the Association in trust and invested in trust securities approved under the provisions of the Income Tax Act and The Maharashtra Public Trusts Act 1950, and to accumulate and aggregate the incomes earned thereon, i.e. the original endowment together with the accrued and aggregated incomes accumulated to be utilised only on the event of my demise to make payment for the carrying out of the obsequial ceremonies specifically listed in the Annexure hereto, for the first year after my demise to the Panthaky of the Agiary who carries out the listed prayers.  Upon the completion of all the listed prayers, as per a written confirmation by the Panthaky, which the Association may rely on, in the event that there be any surplus remaining in the said Endowment made by me, the same shall fall into the general corpus of the Association to be used by the Association in such manner as it may consider fit for its general objectives.
